Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of The Letting Desk, the HMO property management platform for UK landlords and letting agents. The Letting Desk is operated by The Letting Desk Ltd (“The Letting Desk”, “we”, “us” or “our”), a company registered in the United Kingdom.
By creating an account, starting a trial, or otherwise using the service, you agree to these Terms. If you are entering into these Terms on behalf of a business, you confirm that you have authority to bind that business.
1. Definitions
“Service” means The Letting Desk web application, public API, integrations and related services. “Customer Data” means the data you and your authorised users submit to the Service, including property, tenancy, tenant, financial and compliance records. “Subscription” means the plan you select and the associated billing terms.
2. Accounts and eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate account information and to keep it up to date. You must notify us promptly of any unauthorised use of your account or any other breach of security.
3. Subscriptions and billing
Trials
New customers may be offered a free trial. At the end of the trial, your Subscription will begin and the applicable fees will become payable unless you cancel beforehand.
Fees and payment
Fees are billed in advance on a recurring basis (monthly or annually) according to the plan you choose. Per-unit charges are calculated on the number of managed units in your account during the billing period. All fees are stated exclusive of VAT, which will be added where applicable.
Cancellation and refunds
You may cancel your Subscription at any time, effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We do not delete your data immediately on cancellation; you may export it within the retention window described in our Privacy Policy.
4. Acceptable use
You agree not to:
- use the Service in breach of applicable law, including UK housing, data protection, or consumer protection law;
- upload content that is unlawful, infringing, or that you do not have the right to process;
- attempt to gain unauthorised access to the Service, other accounts, or our underlying systems;
- interfere with or disrupt the integrity or performance of the Service, including through excessive or abusive API usage; or
- resell or sublicense the Service except as expressly permitted in writing.
5. Customer Data
As between you and us, you own all Customer Data. You grant us a limited licence to host, process and transmit Customer Data solely to provide and support the Service. Where we process personal data on your behalf, we do so as a processor under the terms of our Data Processing Addendum.
You are responsible for the lawfulness of the Customer Data you submit, including having an appropriate lawful basis for processing tenant and applicant personal data.
6. Availability and support
We aim to keep the Service available and performant, but we do not guarantee uninterrupted access. We may carry out maintenance and will make reasonable efforts to schedule planned downtime sensibly. Support is provided by email and via the channels described on our website.
7. Intellectual property
The Service, including its software, design, and documentation, is owned by The Letting Desk and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the limited right to use it in accordance with these Terms.
8. Disclaimers and liability
The Letting Desk provides software tools; it does not provide legal, tax, accounting, or regulatory advice. Compliance reminders and templates are provided for convenience and do not replace professional advice or your own due diligence.
To the maximum extent permitted by law, the Service is provided “as is”. Nothing in these Terms limits liability that cannot be limited under English law, including for death or personal injury caused by negligence or for fraud. Subject to that, our total aggregate liability arising out of or in connection with these Terms shall not exceed the fees paid by you in the twelve months preceding the event giving rise to the claim.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay fees when due, or use the Service in a way that poses a security or legal risk. On termination, your right to use the Service ends, subject to the data export and retention terms in our Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give you reasonable notice, for example by email or in-app notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
